Netherlands: statutory commercial interest and the 14-day letter

Overdue invoice in the Netherlands: wettelijke handelsrente for B2B, the veertiendagenbrief for consumers and collection cost rules.

In the Netherlands, B2B late payments attract statutory commercial interest (wettelijke handelsrente), the ECB rate plus 8 points. For consumers, statutory interest is lower, and before charging collection costs you must send a 14-day letter (veertiendagenbrief) giving at least 14 days to pay. Collection costs are capped by a sliding scale (WIK). The subdistrict court (kantonrechter) handles claims up to €25,000.
