Late fee wording for freelancers: clauses to put on your invoices

Copy-ready late payment clause wording for freelance contracts and invoices, and why it must be agreed before the work starts.

A late fee is usually only enforceable if the client agreed to it before the work, in your contract or terms. Adding a penalty to an already overdue invoice rarely sticks (UK and EU B2B statutory interest is the exception). Keep fees proportionate: courts in the US, UK and Australia can refuse 'penalty' charges that are out of proportion to your actual loss.

Payment terms: Invoices are due within [14/30] days of the invoice date. Overdue amounts accrue interest at [1.5]% per month (or the maximum rate permitted by law, if lower) from the due date until paid, plus reasonable costs of collection. [UK B2B: We reserve the right to claim interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.] [EU B2B: Statutory interest and a fixed €40 recovery fee apply under Directive 2011/7/EU as implemented locally.]
